These Terms of Service ("Terms") govern your access to and use of the services provided by Aether Labs ("we," "our," or "us"), including our AI services such as AI cold calls, email automation, marketing chatbots, support agents, SMS systems, forum DM bots, social scraping, and review management services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our Services. These Terms apply to all visitors, users, and others who access or use our Services.

Aether Labs provides AI-powered automation services designed to help businesses grow revenue through intelligent systems. Our Services include but are not limited to:

• AI Cold Calls: Automated voice agents that conduct outbound calls and handle conversations
• AI Email: Automated email campaigns with domain warming and personalized messaging
• Marketing Chat Agents: Conversational AI that engages website visitors and generates leads
• Support Agents: AI-powered customer support systems with intelligent handoff capabilities
• SMS Systems: Automated text messaging campaigns with opt-out management
• Forum DM Bots: Automated outreach on forums and social platforms based on relevant conversations
• Social Scraper: Data collection and lead generation from social media platforms
• Reviews and Ranking: Online reputation management and review optimization services

We set up, launch, and run these systems on your behalf. You receive weekly updates and clear performance metrics. Specific features, capabilities, and limitations of each Service are detailed in your service agreement.

When you create an account or engage our Services, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Comply with all applicable laws and regulations
• Use the Services only for lawful purposes and in accordance with these Terms

You are responsible for ensuring that any data you provide to us (including contact lists, content, and instructions) complies with applicable laws, including but not limited to data protection regulations, anti-spam laws, and telemarketing regulations.

You agree not to use our Services to:

• Violate any applicable local, state, national, or international law or regulation
• Transmit or store any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of another's privacy
• Send unsolicited communications (spam) without proper consent and opt-out mechanisms
• Impersonate any person or entity or falsely state or misrepresent your affiliation
• Interfere with or disrupt the Services or servers connected to the Services
• Attempt to gain unauthorized access to any portion of the Services or related systems
• Use the Services to violate the rights of others, including intellectual property rights
• Use automated systems to access the Services in a manner that sends more requests than a human could reasonably produce
• Collect or harvest information about other users without their consent

Violation of this Acceptable Use Policy may result in immediate termination of your access to the Services and may subject you to legal liability.

Payment terms, pricing, and billing cycles are specified in your service agreement or order form. By agreeing to use our Services, you agree to pay all fees associated with your selected plan.

• Fees are billed in advance on a monthly or annual basis, as specified in your agreement
• All fees are non-refundable except as required by law or as otherwise specified in your agreement
• Price changes will be communicated with at least 30 days' notice
• Failure to pay fees may result in suspension or termination of Services
• You are responsible for any taxes, duties, or fees imposed by your jurisdiction
• Payment is processed securely through third-party payment processors

We strive to provide reliable and consistent Services. However, we do not guarantee that the Services will be uninterrupted, error-free, or completely secure. Service availability and performance metrics are detailed in your service agreement.

We reserve the right to:

• Perform scheduled maintenance with reasonable advance notice
• Modify, suspend, or discontinue any aspect of the Services at any time
• Address security threats or technical issues that may require temporary service interruption
• Update or change features, functionality, or capabilities of the Services

The Services, including all content, features, functionality, software, and technology, are owned by Aether Labs and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any data, content, or materials you provide to us. By using our Services, you grant us a limited, non-exclusive license to use, process, and store your data solely for the purpose of providing the Services to you.

You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software, except as permitted by law.

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.

You are responsible for ensuring that any data you provide to us complies with applicable data protection laws and that you have obtained necessary consents for us to process such data on your behalf.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AETHER LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PORTION OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Services will cease immediately. Termination procedures, data export options, and any applicable refunds are detailed in your service agreement.

You may terminate your use of the Services at any time by providing written notice to us. Termination by you does not relieve you of any obligations to pay fees accrued prior to termination.
